These Terms & Conditions govern the use of all broadcast, digital, streaming, marketplace, directory, and event products operated by Carson Communications, including but not limited to: WCCG 104.5 FM, Soul 104.5 FM, 104.5 FM The Vibe, Hot 104.5 FM, Yard N Riddim, The Community Directory, NCTix, The Carson Communications Marketplace, and all associated apps, websites, services, events, contests, and advertising platforms. By accessing or using any Carson Communications product, you agree to these Terms & Conditions.
Acceptance of Terms
By accessing any Carson Communications platform or service, you acknowledge that you have read, understood, and agreed to these Terms & Conditions. If you do not agree, you may not use the services. Carson Communications may update or modify these terms at any time without prior notice. Continued use of the platform constitutes acceptance of revised terms.
Use of the Platform
Users agree to use all Carson Communications products only for lawful purposes. You may not interfere with platform operation or security, use the platform for fraudulent or abusive behavior, upload content you do not own or have rights to, misrepresent your identity or business, or attempt to reverse-engineer, scrape, or access restricted systems. Carson Communications may restrict or terminate access for any violation.
Account Registration & Security
Certain services require creating an account, such as the Marketplace, Directory, NCTix, Advertiser Portal, or Listener Rewards. You agree to provide accurate information and keep login credentials secure. You are fully responsible for all activity that occurs under your account. Carson Communications is not liable for unauthorized access resulting from user negligence.
User-Generated Content
User-submitted content, including business listings, event postings, advertisements, images, audio, and text, must comply with legal and platform requirements. You represent that you own or have legal rights to all content you submit and that the content does not violate privacy, trademark, copyright, or other intellectual property rights. Content must not be misleading, harmful, offensive, or otherwise unlawful. Carson Communications may remove or reject any content at its discretion.
Advertising, Sponsorships & Marketplace Listings
Advertisers and vendors using WCCG 104.5 FM, the Marketplace, or any Carson Communications product agree that all advertising, listings, and promotions must be truthful, legal, and non-misleading. Advertisers are responsible for fulfilling all offers, promotions, and claims. Creative submissions must comply with FCC standards, state law, and platform guidelines. Carson Communications may edit, decline, suspend, or remove content that violates policies. All advertising campaigns require signed agreements and approvals. Users understand that audience metrics are estimates and not guaranteed outcomes. Carson Communications is not responsible for losses, disputes, or damages arising from marketplace activity or advertiser claims.
Intellectual Property Rights
All Carson Communications-owned content—including branding, logos, broadcasts, text, audio, video, and website materials—is protected by trademark and copyright law. Users may not reproduce, copy, or transmit platform content without written permission.
Broadcast Content & FCC Compliance
Carson Communications complies with all FCC regulations. Users submitting advertising or promotional material must ensure all claims are verifiable and compliant with broadcast standards. Certain industries, such as finance, healthcare, and alcohol-related services, may require additional disclaimers or approvals. Carson Communications may refuse content that could violate FCC statutes.
Digital Services & Online Marketplace
The Carson Communications Marketplace, NCTix, and Community Directory allow businesses to list products, events, and promotional services. Carson Communications is not the seller of third-party goods or services and is not responsible for vendor or consumer disputes, misrepresentations, unfulfilled listings, or fraudulent activity. Users must resolve disputes directly with the vendor or business. Carson Communications reserves the right to remove listings due to violations or complaints.
Payments & Billing
Users participating in advertising, promotions, upgrades, or premium marketplace features agree to complete payment according to agreed-upon terms. Payments are final unless otherwise specified in writing. Services may be paused or suspended for nonpayment. Advertisers and vendors are responsible for all deals, promotions, and offers they choose to publish.
Events, Ticketing & NCTix
By using NCTix or attending any Carson Communications-managed event, you acknowledge that event details may change at any time. Carson Communications is not responsible for venue changes, performer cancellations, or third-party vendor issues. Refunds follow the event’s posted refund policy. Attendees participate at their own risk. Carson Communications is not liable for injuries, damages, or losses that occur before, during, or after events.
Listener Rewards & Loyalty Programs
Listener reward points, bonuses, or incentives offered through Carson Communications platforms have no cash value. These programs may be changed, suspended, or discontinued at any time. Points are promotional and not guaranteed. Carson Communications may revoke points or rewards if fraudulent activity or misuse is detected.
Privacy Policy
Carson Communications maintains a separate Privacy Policy that governs how user information is collected, stored, and used. By using any Carson Communications service, you agree to the terms outlined in the Privacy Policy.
Limitation of Liability
Carson Communications, including its affiliates and employees, is not liable for lost profits, business interruption, data loss, technical issues, unauthorized access, content errors, third-party failures, marketplace disputes, or event-related injuries or damages. Liability is limited to the amount paid for the specific service involved, if applicable.
Indemnification
Users agree to indemnify and hold harmless Carson Communications from any claims, losses, damages, liabilities, or expenses arising from misuse of the platform, violations of these terms, intellectual property disputes, marketplace or advertising activity, or user-generated content.
Termination of Service
Carson Communications may suspend or terminate access to any platform or service at any time for policy violations, fraudulent activity, legal concerns, nonpayment, or harmful content. Outstanding obligations remain enforceable after termination.
Governing Law
These Terms & Conditions are governed by the laws of the State of North Carolina. Any legal disputes must be resolved in courts located in Cumberland County, North Carolina.
